MotoTigo Terms of Service

The rules for using the MotoTigo mobile app and the related portal. Please read them carefully — using the Service means you accept these Terms.

General provisions and definitions

These Terms set out the rules for using the MotoTigo Service. The provider is MLG Trade sp. z o.o. sp. k., with its registered office at ul. Nagietkowa 58, 81-589 Gdynia, Poland (the “Provider”, “we”). Contact: rider1@mototigo.com. The following terms mean:

  • “Service” / “MotoTigo” — the MotoTigo mobile app (Android, iOS) and the related web portal.
  • “User” — a person who uses the Service.
  • “Consumer” — a User who is a consumer within the meaning of applicable law.
  • “Content” — data entered or created by the User (trips, GPS tracks, voice notes and transcripts, photos, descriptions).
  • “SOS” — the community breakdown-alert feature.
  • “The “Maya” assistant” — the AI-based voice assistant feature.

Acceptance of the Terms and scope

Starting to use the Service (installing, registering, or using the app or portal) means you accept these Terms. If you do not accept them, do not use the Service.

The Service is intended solely for adults (18 years and older).

The Terms are provided in Polish, English, German and Spanish. In the event of any discrepancy, the Polish version prevails.

Description of the Service

MotoTigo is a mobile travel journal and navigation aid for motorcyclists and drivers. The Service includes, among others: route guidance and route planning, GPS track recording, voice notes with transcription, adding photos, the “Maya” voice assistant and the SOS feature.

The Service is supplementary and informational in nature. It is not a professional or certified navigation, rescue or safety system and does not replace the User's own assessment of the situation.

Safety and responsible use

Road safety comes first. The User is solely responsible for how they use the Service while riding and undertakes in particular that they will:

  • keep their eyes on the road and full control of the vehicle at all times;
  • perform any task that requires looking at and interacting with the screen — in particular planning and editing routes, searching for places, entering a destination, browsing the journal and changing settings — only while stopped, in a safe and lawful place, and never while riding;
  • treat navigation as an aid, not an instruction — road signs, signals, traffic rules and actual road conditions always take precedence;
  • comply with traffic rules and the law applicable in the given location;
  • mount the device so that it does not obstruct visibility or control of the vehicle, and not operate it in a way that endangers safety;
  • hold a valid driving licence and the required insurance, and use a vehicle that is technically roadworthy.

Nature of the data and no accuracy guarantee

Maps, routes, points of interest (POI), traffic, weather, GPS position, travel time and distance, and transcriptions are provided “as is” and may be inaccurate, incomplete or out of date. A route shown in the app is a suggestion, not an instruction to ride a given road.

Some data comes from third-party providers, and in some cases (e.g. for motorcycles in Europe) car routing is used. The User must independently verify the passability, legality and safety of a route on site and follow road signs and local law. The Provider does not guarantee the accuracy, completeness or availability of the data.

SOS is not an emergency service

The SOS feature is a community breakdown alert. You should understand its limitations:

  • SOS sends a notification about your breakdown to other app users nearby (by default within about 30 km) who have enabled receiving such notifications;
  • SOS is NOT connected to emergency services (112) or any professional rescue centre and is not monitored by the Provider;
  • neither delivery of the notification nor any response is guaranteed — an alert may not reach anyone;
  • SOS depends on network coverage, battery, GPS and the proper functioning of third-party services;
  • in a situation that threatens life or health, immediately call the emergency number 112 (or the relevant local number);
  • using SOS involves sharing your location and data with other users (see the Privacy Policy).

The “Maya” assistant

The “Maya” assistant generates answers automatically using artificial intelligence and third-party services. The answers may be inaccurate, incomplete or wrong and are for information only.

The assistant's answers do not constitute legal, medical, technical or navigational advice. Do not rely on them for decisions affecting safety. You use the assistant at your own risk.

Account and registration

Some features require an account. The account is shared between the mobile app and the portal. The User is responsible for the accuracy of the data provided, for keeping login credentials confidential, and for actions taken on their account.

The User may at any time request deletion of their account together with the associated data by contacting rider1@mototigo.com.

User Content

The User retains rights to their Content. By posting Content in the Service, the User grants the Provider a non-exclusive, royalty-free licence to host, store, process and back it up to the extent necessary to provide the Service.

The User represents that they hold the rights to the Content posted (including photos and recordings) and that it does not infringe the law or third-party rights. Content marked as public is shared by the User at their own risk. Posting unlawful, offensive or rights-infringing content is prohibited.

Acceptable use

The User undertakes to use the Service in accordance with the law and these Terms. The following are prohibited in particular:

  • using the Service for unlawful purposes or in a way that infringes third-party rights;
  • decompiling, reverse engineering or attempting to obtain the source code, unless mandatory law allows it;
  • automated data harvesting (scraping), overloading or interfering with the operation of the Service;
  • circumventing security measures or feature restrictions.

Plans and payments

The Service may offer different plans (e.g. Free, Pro, Gold, Diamond). Currently, use of the plans may be free of charge.

If paid plans are offered in the future, they may be purchased through the Google Play or Apple App Store and will be subject to those stores' terms. Billing, renewals, refunds and cancellation of subscriptions bought in the stores are handled by the relevant store.

Right of withdrawal (Consumer)

A Consumer generally has the right to withdraw from a distance contract within 14 days.

For digital content or services supplied before that period ends, performance begins with the Consumer's express consent and after acknowledging that, once performance begins, the right of withdrawal is lost. Subscriptions purchased in an app store can be cancelled in accordance with that store's rules.

No warranty

The Service and all data are provided “as is” and “as available”, without any guarantee of uninterrupted, error-free or secure operation. To the extent permitted by law, the Provider disclaims implied warranties, including fitness for a particular purpose.

Limitation of liability

To the maximum extent permitted by law, the Provider is not liable for indirect, consequential or incidental damages, or for loss of data, profits or use, arising from the use of or inability to use the Service, including reliance on navigation data, the assistant's answers, or the SOS feature.

The above limitations do not exclude or limit liability that cannot be excluded under mandatory law — in particular for damage caused intentionally (Art. 473 § 2 of the Polish Civil Code), for gross negligence, for death or bodily injury, or rights afforded to Consumers.

The User is solely responsible for how they use the Service, including how they ride, their choice and completion of a route, and compliance with the law.

Indemnification

The User undertakes to hold the Provider harmless and to cover reasonable costs and third-party claims arising from the User's breach of these Terms or the law, or from improper use of the Service, to the extent permitted by law.

Third-party services and content

The Service uses third-party solutions (including Google/Firebase, app stores, providers of maps, routes, traffic and weather data, and AI service providers). Their use may be subject to those entities' separate terms. The Provider is not responsible for the operation, availability or content of third-party services.

Intellectual property

The app, the portal, the marks, the MotoTigo brand and the content provided by the Provider are protected by law and belong to the Provider or its licensors. The User receives a limited, revocable, non-exclusive and non-transferable licence to use the Service in accordance with these Terms. Any use beyond that licence is prohibited.

Data protection

The rules for processing personal data are described in the Privacy Policy, which supplements these Terms.

Changes to the Service and the Terms

The Provider may develop, change or restrict features of the Service and update these Terms for important reasons (e.g. legal, technical, or changes to the scope of the Service). The Provider will announce significant changes in the app or on the portal. Continued use of the Service after the changes take effect means you accept them; a Consumer who does not accept the changes may stop using the Service.

Term, termination and suspension

The User may stop using the Service and delete their account at any time. The Provider may suspend or terminate the Service for a User who breaches these Terms or the law, to the extent permitted by law and with respect for Consumer rights.

Governing law and dispute resolution

These Terms are governed by Polish law. This choice does not deprive a Consumer of the protection of the mandatory provisions of the law of their country of habitual residence.

A Consumer may use out-of-court complaint and redress mechanisms, including the EU online dispute resolution (ODR) platform.

Final provisions and contact

If any provision of these Terms turns out to be invalid or ineffective, the remaining provisions remain in force. These Terms constitute the entire agreement regarding the use of the Service.
